I know each FSDO has their own interpretations on the rules, but I can give you my experience in dealing with a couple of different FSDO's. The rules basically say that you can only have crew members that are required for the flight. If there is an absolute need for a second person during the 25 or 40 hour flight test period, and you can justify it, then it is fine. The problem is that most FSDO's say there is no way you can justify a second person, at least in most single engine airplanes. A flight instructor is not required for the flight test, therefor it is not allowed. Personally I don't feel it's a very good idea to be getting, or giving flight instruction during this time anyway. It's extremely important to have someone competent flying the type airplane being tested.
