The way I understood this situation is as follows: When flying VFR but finding I need to ascend through a layer, I too ask for "IFR to VFR on top" routinely. They will usually ask I the plane is equipped for IFR flight, ask type, etc., but then give me a squawk and a clearance. True, I did not file a flight plan in advance, but I interpret what just occurred is that they essentially put one in the system for me. I am now on an IFR clearance/plan, which I need to cancel once I am in the clear. Either way, a great option with usually very cooperative controllers, at least in my area of the world. Douglas W.
