Per FAR 91.109 "no person may operate a civil airplane that is being used for flight instruction unless it has  fully functionioning dual controls."  An exemption is made for instrument instruction with a throwover yoke. This includes Biennial Flight Reviews, since they are defined as instructional flights. Brakes are not part of the dual control requirement per the FAA.

A waiver for flight instruction in a single control aircraft may be granted by the Administrator upon request. The American Bonanza Society holds a waiver for flight instruction at their clinics. Jeff Edwards CFII
