VNE is not always set for true airspeed! Depends on the
aircraft, but yes Vans is based on true airspeed. Also, flutter does not ALWAYS
happen at max speed. V-tail Bonanzas had just as many failures in
the landing approach as at cruise. 1 aircraft that comes to mind right away
was the V-tail in Arizona in the mid 80's it let loose on a 1/2 mile
final.

Much to my surprise, VNE is true airspeed, not indicated. It's pretty easy to
exceed in my Lancair. Results can be explosive, meaning onset of flutter to
component failure can be nearly instantaneous. I can't wear a parachute in my
plane (Lancair 320), so I wouldn't screw around with
it.
