Probably pointing out the obvious; I think the point is that the legal costs of defending any position/ sales agreement/ product liability suit could be devastating.

A few years ago, I took an "Introduction to Homebuilding" course taught by Charlie Becker from EAA.  He claimed that there had never been a successful lawsuit against a homebuilder, which is reassuring, but I understand that's not a guarantee that you or I won't be the first one.  
 
He wasn't very enthusiastic about contractual attempts to limit the homebuilder's liability (liability waivers), but I think EAA has a sample waiver on their website.  I'd suggest giving Charlie a call at EAA and discussing it with him.
