N8700.42 is a Notice that is intended to clarify the new reg 14CFR61.31 (k)(2)(iii)(B) which is a new regulation.  It was made law on July 27, 2004 and was titled "Certification of Aircraft and Airmen for the Operation of Light-Sport Aircraft; Final Rule".
 
The E.A.A. has made an intrepretation and Claudette Colwell posted this yesterday to the group.  I quote.....

The key is that if you are currently hold a pilot certificate with a SEL airplane category/class rating, then you don't need to do anything to fly passengers in a SEL experimental airplane. However, if your SE airplane is on floats, and you only held a SEL rating, then you would need to comply with the conversion requirements before flying passengers.

So my suggestion is to do your own research on this. There definately is a rule.  Every pilot must determine if he has to change something.

The Notice 8700.42, is not a FAR rule and is only advisory in nature. The notices are for information and cannot be used in any enforcement case. Trying to enforce a Notice is like trying to enforce an Advisory Circular they are for information only.
Your phase 1 and 2 limitations are what you have to go by. Until part 61 is changed nothing will happen. However I think all pilots should send a comment to the FAA or your local congress person stating how you feel about the FAA changing rules. The squeaky wheel gets greases so to speak.

Am I missing something here?  Does this discussion imply that
homebuilders were in some way exempt from rating requirements?  It
sounds that its water under the bridge anyway.  Curious what I'm missing?
