If he got an FAA FSDO inspector to sign off on the ferry permit-- then, yes. FAR 91.213(d) applies. But say you safety wired the mixture to full rich and had a problem requiring something less than full rich, you would be in a jam. What if you were taking off from a high density altitude airport? Where would you put the mixture?
I have worked two fatal accidents involving this very issue. Five fatalities total.
