I personally know several builders who have had similar experiences with Performance.  Recently, serious threat of legal action has gotten reasonable response out of them.  Another tactic that had some success was putting their business phone number on speed dial and then dialing it repeatedly, non-stop until they finally responded.  Then doing it again a few days later when they didn't deliver as promised.  I guess you have to become a big enough nuisance, or legal threat, to get satisfaction.
