Chuch Jenson rightly pointed out that "Loser Pays"
limits court access. A reasonable reform was thought to be the Contingency Fee
attorney. But that introduces a lottery mentality. The plaintiff has nothing to
lose.
A reasonable but not yet implemented reform would
be to define the Contingency Fee attorney to be the business partner of the
plaintiff. Then you re-institute Loser Pays. If the plaintiff is a pauper, then
the attorney antes up. Count on it, only good cases would make it to court.
