My FSDO inspector told me that the spirit of the rule was to stop those idiots from taking their kid, uncle, etc. on a joy ride during the test phase. He said "Just make sure the person in the right seat has a kneeboard strapped on when you go in."
All this really illustrates is the regional and personal differences in interpreting the "Regs."
