I'll paste the entire
post that the DAR made on the gyro forum. As you can see, DARs are issued
documentation with notes to guide them in issuing the operating limits.
According to the FAA notes, item 17 doesn't apply to us at all. I wouldn't
have a problem with seeing both items listed, as long as the notes are included
to clarify things.
So far, Bob White is the
only one who's replied off list, and he only has item 18, which is as it should
be.
Unfortunately, as is
usually the case, the actual requirements are not decided by the FAA, but
instead by the insurance company. I realized after I sent the original
post that I'm required to have a (category class) gyro rating of some kind in
order to get liability insurance. Since my hanger lease requires it, then
the insurance folks seem to be in charge.

I see where the confusion came in. This is
unchanged as long as I can remember. The bold "notes" are not part of the OPS
limits and are there for ASI & DAR guidance.
(17) The pilot
in command of this aircraft must hold an appropriate category/class rating. If
required, the pilot in command also must hold a type rating in accordance with
part 61, or a letter of authorization issued by an FAA Flight Standards
Operations Inspector.
NOTE: This limitation applies to any
turbojet/turbofan-powered aircraft, any aircraft with a maximum takeoff
weight exceeding 12,500 pounds, and any other aircraft when deemed necessary.
The Flight Standards inspectors should refer to FAA Order 8700.1, General
Aviation Inspector’s Handbook, for further guidance.
(18) The
pilot in command of this aircraft must hold a pilot certificate or an authorized
instructor’s logbook endorsement. The pilot in command also must meet the
requirements of § 61.31(e), (f), (g), (h), (i), and (j), as
appropriate.
NOTE: This operating limitation applies to most
amateur-built aircraft as a standard operating limitation (reference §
61.31(k)).
